Introduction

Welcome to Img2Img AI, an all-in-one AI image generation and editing platform. These Terms of Service ("Terms") govern your access to and use of the Img2Img AI website, applications, tools, prompts, content, and related services (collectively, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you have questions about these Terms, review our Privacy Policy or contact [email protected].

Eligibility and Accounts

You must be legally able to enter into these Terms in your jurisdiction to use the Service. If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

Certain features require an account. You agree to provide accurate, current, and complete registration information and to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

Img2Img AI may offer sign-in through email/password and third-party authentication providers such as Google or GitHub. If you believe your account has been accessed without authorization, notify us promptly.

The Service

Img2Img AI provides AI-powered creator tools that may include, depending on the feature or plan you use:

image generation and image-to-image editing;
one-click effects, background changes, restoration, enhancement, retouching, outpainting, and similar image workflows;
prompt libraries, tutorials, docs, and creator resources;
subscriptions, recurring credits, one-time credit packs, and other paid usage features.

We may add, remove, update, suspend, or discontinue models, tools, features, pricing, or workflows at any time. We do not guarantee that any particular model, effect, or feature will remain available for any specific period.

Permitted Use

Subject to these Terms, Img2Img AI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for lawful internal, personal, or business use.

You may use the Service only in compliance with these Terms and applicable law.

Prohibited Conduct

You agree not to:

use the Service for illegal, fraudulent, abusive, or harmful activity;
upload, generate, edit, or distribute content that is infringing, defamatory, obscene, sexually explicit, exploitative, or otherwise unlawful;
create deceptive deepfakes, unauthorized impersonation content, or misleading synthetic media that violates law, platform rules, or third-party rights;
upload images, logos, likenesses, prompts, or other materials that you do not have the right to use;
input highly sensitive personal data unless you are legally authorized to do so and such use is necessary;
interfere with the Service, scrape the Service, circumvent rate limits or security measures, or access it through unauthorized bots or automation;
reverse engineer, decompile, or attempt to extract source code, system prompts, or model behavior except where prohibited by law;
upload malware, viruses, or harmful code;
use the Service in a way that harms minors or exploits vulnerable individuals;
misrepresent AI-generated content as purely human-made where disclosure is legally required.

We may investigate suspected violations, remove content, limit access, or suspend accounts to protect users, partners, and the Service.

User Content

Ownership and Responsibility

You retain ownership of the prompts, source images, files, and outputs you submit to or generate through the Service ("User Content"), to the extent permitted by law.

You are solely responsible for your User Content, the instructions you give the Service, and your use of any outputs. You represent and warrant that you have all rights, consents, and permissions necessary to submit your User Content and to use the outputs as contemplated by these Terms.

License to Img2Img AI

You grant Img2Img AI a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, transform, and otherwise process your User Content solely as necessary to operate, secure, maintain, troubleshoot, improve, and provide the Service to you.

For clarity, Img2Img AI does not use your private uploads, prompts, or generated outputs to train its own models.

AI Outputs

AI systems are probabilistic. Outputs may be inaccurate, incomplete, inconsistent, or similar to results generated for other users.

As between you and us, you retain rights in outputs generated for your account to the extent permitted by law, subject to applicable law, third-party rights, provider restrictions, and the rights in any source materials you submit. You are responsible for reviewing outputs before using, publishing, licensing, or relying on them.

Intellectual Property and Feedback

All rights, title, and interest in the Service, including the website, software, interface design, workflows, branding, logos, and all content provided by Img2Img AI other than your User Content, are owned by Img2Img AI or its licensors.

Except for the limited access rights expressly granted in these Terms, no rights are granted to you by implication or otherwise.

If you send us ideas, suggestions, or feedback about the Service, you grant us the right to use them without restriction or compensation to you.

Payment, Credits, and Subscriptions

Paid Features

Some features require payment, subscription enrollment, or available credits. You agree to pay all fees, taxes, and charges associated with your use of the Service.

Payments may be processed by third-party providers such as Stripe, Creem, PayPal, or other processors we support from time to time.

Credits

Img2Img AI may use a credit-based system. Different models, tools, output types, and settings may consume different amounts of credits. Credit requirements may change at any time, and the amount shown in the product at the time of use controls.

Credits may be provided through subscriptions, promotions, gifts, free trials, or one-time purchases. Unless otherwise stated, credits are non-transferable, non-cash, and may expire.

Subscription Renewal and Cancellation

If you purchase a subscription, it may renew automatically for the renewal term shown at checkout unless you cancel before the next billing date.

You can manage or cancel subscriptions through your billing settings. Cancellation affects future renewals, and already granted credits remain subject to their listed validity or billing-period rules.

Refunds

Except where required by applicable law or expressly stated by us, payments, subscriptions, and credit purchases are non-refundable. We may, in our sole discretion, issue refunds, credits, or billing adjustments in specific cases.

Third-Party Services

The Service depends on third-party providers for authentication, payments, cloud infrastructure, storage, analytics, email delivery, and AI processing. Your use of some features may therefore also involve third-party terms, policies, and technical limitations.

To the extent allowed by law, Img2Img AI is not responsible for third-party outages, policy changes, provider-side restrictions, or failures caused by those providers.

Termination

Termination by You

You may stop using the Service at any time. You may also request account deletion or cancel applicable subscriptions through your account settings or by contacting support.

Termination by Img2Img AI

We may suspend, restrict, or terminate your account or access to the Service, with or without notice, if:

you violate these Terms;
your use creates legal, security, fraud, or operational risk;
payment fails or chargebacks occur;
we are required to do so by law or by a provider relationship;
we discontinue the Service or a relevant feature.

Effect of Termination

Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive, including provisions on payments, User Content licenses, intellectual property, disclaimers, limitations of liability, indemnification, and dispute-related terms.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Img2Img AI disclaims all express, implied, statutory, or other warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability.

AI outputs may be inaccurate, biased, offensive, or unfit for your intended use. We do not guarantee that outputs will be correct, lawful, unique, or suitable for any particular purpose.

Limitation of Liability

To the maximum extent permitted by law, Img2Img AI and its affiliates, officers, employees, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, business opportunity, data, or use arising out of or related to the Service.

To the maximum extent permitted by law, Img2Img AI's aggregate liability for all claims arising out of or relating to the Service will not exceed the amount you paid to Img2Img AI for the Service during the three (3) months before the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Img2Img AI and its affiliates, officers, employees, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

your User Content;
your use of the Service;
your violation of these Terms; or
your infringement or violation of any third-party rights.
